- Sweepstakes Period: The Timber Wolf "Year of Tobacco" Sweepstakes (the "Sweepstakes") begins at 12:00:01 p.m. Eastern Time ("ET") on February 1, 2010 and ends at 11:59:59 a.m. ET on December 17, 2010 (the "Sweepstakes Period").
- How To Enter: During the Sweepstakes Period, if you already have an account on www.TimberWolfSnuff.com (the "Site") you may receive an entry into the Sweepstakes by logging onto the Site and clicking on the Sweepstakes link. If you do not have an account, you must visit the Site and complete all required registration information to enter into the Sweepstakes. Limit one entry per person/email address per day. Normal Internet access and usage charges imposed by your on-line service provider will apply. All entries become the property of Pinkerton Tobacco Co. LP ("Sponsor").
- Bonus Entries: Once you have completed your entry into the Sweepstakes, you may earn one additional entry per week into the Sweepstakes by successfully referring a friend, who must meet the eligibility criteria outlined below ("Bonus Entry"). You must provide a valid e-mail address of the eligible friend you would like to refer, or the Bonus Entry will not be awarded. Limit one Bonus Entry per person/e-mail address per week for the Sweepstakes. You may not refer a friend more than once. Please note, if your friend has previously opted-out of receiving emails from Sponsor, he/she will not receive your referral email. Your referred friend is not required to enter the Sweepstakes to earn your Bonus Entry. Referred friends must be legal residents of, and currently residing in, the contiguous 48 United States and the District of Columbia (excluding residents of VA, MA & MI) and 21 years of age and older.
- Random Drawing: There will be 46 potential weekly winners selected (one per week) in weekly random drawings from among all eligible entries, including Bonus Entries received during each week. For purposes of this Sweepstakes, the weekly random drawing entry period is defined as each Monday at 12:00:00 a.m. ET through each Sunday at 11:59:59 p.m. ET with the exception being the first week and the last week of the Sweepstakes. The first week's random drawing entry period will begin at 12:00:01 p.m. ET on Monday, February 1, 2010 and end at 11:59:59 p.m. ET on Sunday, February 7, 2010. The last week's random drawing entry period will begin at 12:00:00 a.m. ET on Monday December 13, 2010 and end at 11:59:59 a.m. ET on Friday, December 17, 2010. Eligible entries received will only be entered into the weekly random drawing for the week the entry was received and will not be entered into subsequent weekly drawings, if any. Random drawings will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible entries received during each week. All prizes will be awarded and winners will be notified by phone and email.
- Prizes And Approximate Retail Value ("ARV"): Weekly Prizes (46 - one per week during Sweepstakes Period): $1,000 Sponsor-specified gift card. (ARV: $1,000). Limit one prize per person/household/email address. Expiration date may apply to gift card. Prizes are nontransferable and winners may not substitute prizes. Income and other taxes, if any, related to the prize are the winner's sole responsibility.
- Eligibility: Open to legal residents of, and currently residing in, the contiguous 48 United States and the District of Columbia (excluding residents of VA, MA & MI), who are 21 years of age and older as of date of entry. Employees of Sponsor and any of its affiliates, parents or subsidiaries, respective parent, subsidiary, and affiliate companies and advertising and promotion agencies, persons engaged in the development of Sweepstakes materials or events, and Don Jagoda Associates, Inc., and members of their immediate families (spouses, parents, children, and siblings and their spouses) living in the same household of each are not eligible. Groups, clubs, organizations, commercial entities and businesses cannot participate. Void in VA, MA & MI and where prohibited by law and subject to all federal, state and local laws.
- General Rules: Each Potential Weekly winner will be contacted via telephone and will be required to execute and return an affidavit of eligibility and liability/publicity release (where legal) within seven (7) days of notification attempt sent via email/mail or prize will be forfeited and an alternate winner selected. Return of prize notification as undeliverable may result in disqualification and alternate selection. Acceptance of prize constitutes permission to use winner's name and likeness for promotional purposes without further compensation except where prohibited by law. By entering, entrant accepts and agrees to be bound by these Official Rules and the decisions of the judges. Winners and all entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor, Don Jagoda Associates Inc., their respective parents, subsidiaries, affiliated companies, promotion agencies ("Administrators") and each of their respective officers, directors, shareholders, members, employees, agents, assigns and all others associated with the development and execution of this Sweepstakes from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of any prize awarded or any typographical or other error in these Official Rules or the announcement of offering of the prizes. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter, will be deemed to be the entrant. "Authorized account holder" of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or the Site; violates the Official Rules; acts in an unsportsmanlike or disruptive manner: or acts with intent to annoy, abuse, threaten or harass any other person. Sponsor and its Administrators are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the online entries in this Sweepstakes. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will award applicable weeks' prizes from among all eligible entries received for the weeks prior to the cancellation/termination of the Sweepstakes. As a condition of entering the Sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys fees.
